The preferred holiday period approaches, here is some general information about the main rules regarding holiday enjoyment.

As a rule, the employee is entitled to a minimum period of 22 working days of vacation per year.

For vacation purposes, working days are the days of the week from Monday to Friday, except for holidays.

If the employee's rest days coincide with working days, Saturdays and Sundays that are not public holidays are considered for the purpose of calculating vacation days, replacing those days.

However, there are also special rules for implementing this right, as is the case of holidays in the year of the employee's admission; when the employment contract duration is of less than 6 months; in the case of prolonged impediment that began in the previous year (e.g.: sick leave); or in the case of termination of the employment contract in the civil year following the admission or whose total duration does not exceed 12 months.

The employee must not accumulate vacations from several years, and vacations must be taken in the calendar year in which they accrue. However, if there is an agreement between employer and employee, or whenever the employee wishes to take vacations with family members living abroad, these can be taken until April 30th of the following calendar year, accumulated or not with those due at the beginning of this calendar year. year.

Furthermore, by agreement between employer and employee, the latter may accumulate half of the vacation period accrued in the previous year with that accrued in the year in question.
